Allgemeine Geschäftsbedingungen
Das Wichtigste vorweg: Ich empfehle dir für jede gebuchte Tour eine Stornoversicherung (z. B. über die Europäische Reiseversicherung). Kurzfristige Absagen wegen Krankheit, Verletzung oder aus beruflichen Gründen kommen leider häufig vor – mit einer Stornoversicherung bleibst du nicht auf den Kosten sitzen.
1. Vertragspartner und Geltungsbereich
Vertragspartner ist Thomas Engl, staatlich geprüfter Berg- und Skiführer (Lizenz ITBZ000416), Tasaweg 3, I-39037 Vals / Mühlbach (BZ). Diese Bedingungen gelten für alle Führungen, Kurse und Gutscheine, die du bei mir buchst.
2. Tarif
Die Preise auf dieser Website verstehen sich pro Person und richten sich nach der Gruppengröße, der Schwierigkeit und den objektiven Gefahren der Tour. Grundlage ist der Mindesttarif der Südtiroler Berg- und Skiführer, der jährlich für das Folgejahr festgelegt wird. Wird eine Tour sehr früh gebucht (z. B. mehr als ein Jahr im Voraus) und ändert sich der Mindesttarif, kann ich den Preis in Absprache mit dir anpassen; in diesem Fall kannst du kostenlos stornieren. Für Mehrtagestouren und individuell geplante Touren erhältst du vorab ein eigenes Angebot mit Gesamtpreis.
3. Nicht enthaltene Kosten
Nicht im Preis enthalten sind deine Anreise, Verpflegung und Übernachtung (auch Halbpension auf Hütten), Getränke sowie Lift-, Taxi-, Maut- und sonstige Transportkosten – für dich und, bei Touren mit Übernachtung, Lift oder Taxi, anteilig auch für mich. Die Spesen sind bei jeder Tour angegeben oder werden im Angebot genannt. Außerplanmäßige Mehrkosten (z. B. durch eine wetterbedingte Routenänderung) entstehen nur in Absprache mit dir. Auf Wunsch schätze ich dir die Gesamtkosten vorab grob ab; verbindlich sind die jeweils aktuellen Preise von Hütten und Liften.
4. Anfrage, Buchung und Bezahlung
Anfragen über diese Website, per E-Mail, Telefon oder WhatsApp sind unverbindlich. Eine Tour ist verbindlich gebucht, sobald ich sie dir schriftlich (E-Mail oder WhatsApp) bestätigt habe. Mit der Bestätigung bekommst du alle Infos zur Tour und bei Bedarf eine Ausrüstungsliste. Bei Mehrtagestouren, Kursen oder Hüttenreservierungen verlange ich eine Anzahlung von 30 %; die Buchung wird erst mit Eingang der Anzahlung verbindlich. Der (Rest-)Betrag ist nach der Tour fällig, bar oder per PayPal bzw. Überweisung.
5. Kein Widerrufsrecht
Da es sich um Freizeitdienstleistungen zu einem bestimmten Termin handelt, besteht gemäß Art. 59 Abs. 1 Buchst. n) des italienischen Verbraucherschutzgesetzbuchs (D.Lgs. 206/2005) kein gesetzliches Widerrufsrecht. Es gelten die folgenden Stornobedingungen.
6. Stornierung durch dich
Eine Stornierung ist jederzeit schriftlich (E-Mail oder WhatsApp) möglich. Da kurzfristig abgesagte Termine meist nicht mehr nachbesetzt werden können, gelten folgende Stornogebühren:
Tagestouren
- bis 21 Tage vor der Tour: kostenlos
- 20 bis 8 Tage vorher: 50 % des Tourpreises
- 7 bis 3 Tage vorher: 75 % des Tourpreises
- ab 2 Tagen vorher oder bei Nichterscheinen: 100 % des Tourpreises
Mehrtagestouren und Kurse
- bis 60 Tage vor der Tour: die Anzahlung wird einbehalten
- 59 bis 30 Tage vorher: 50 % des Gesamtpreises
- 29 bis 10 Tage vorher: 75 % des Gesamtpreises
- ab 9 Tagen vorher oder bei Nichterscheinen: 100 % des Gesamtpreises
Stornokosten Dritter (Hütten, Unterkünfte, Tickets usw.) gebe ich eins zu eins weiter; du bekommst eine Aufstellung. Stellst du eine geeignete Ersatzperson, fallen keine Stornogebühren an.
7. Wetter und Verhältnisse
Ob eine Tour wegen Wetter oder Verhältnissen stattfinden kann, entscheide allein ich als Bergführer – das ist Teil meiner Verantwortung. Ist die geplante Tour nicht möglich, biete ich dir eine gleichwertige Alternative an. Lehnst du diese ohne triftigen Grund ab, gelten die Stornobedingungen. Ist keine sinnvolle Alternative möglich, suchen wir gemeinsam einen Ersatztermin; zusätzliche Kosten entstehen dir dann nicht. Wolken am Gipfel oder eine eingeschränkte Aussicht sind kein Grund für einen Preisnachlass.
8. Voraussetzungen, Programmänderung und Abbruch
Die in der Tourenbeschreibung genannten Voraussetzungen (Kondition, Technik, Ausrüstung) sind Teil des Vertrags. Bitte schätze dich ehrlich ein und informiere mich über gesundheitliche Einschränkungen. Aus Sicherheitsgründen kann ich Route oder Programm ändern, einzelne Teilnehmer ausschließen oder die Tour abbrechen – etwa bei Wetterumschwung, schlechten Verhältnissen oder wenn die Voraussetzungen nicht erfüllt sind. Ein Anspruch auf Preisminderung besteht in diesen Fällen nicht.
9. Absage durch mich
Muss ich eine Tour absagen (z. B. wegen Krankheit, Verletzung oder dauerhaft ungeeigneter Verhältnisse), suchen wir einen Ersatztermin oder ich organisiere einen Bergführer-Kollegen. Ist beides nicht möglich, bekommst du bereits bezahlte Beträge vollständig zurück; Stornogebühren fallen für dich nicht an.
10. Versicherung
Ich bin über die Sammelpolizze des Verbands der Südtiroler Berg- und Skiführer berufshaftpflichtversichert (Deckung 10 Mio. € pro Person und Schadensfall, weltweit mit Ausnahme von USA und Kanada). Für dich selbst sind im Tourpreis keine Versicherungen enthalten. Ich empfehle dir eine eigene Kranken-, Unfall- und Bergekostenversicherung – z. B. über die Mitgliedschaft in einem Alpenverein – sowie eine Storno- bzw. Reiserücktrittsversicherung.
11. Eigenverantwortung und Haftung
Auch bei sorgfältiger und umsichtiger Führung bleiben am Berg Restrisiken, die niemand ausschließen kann – etwa Absturz, Steinschlag, Lawinen, Spaltensturz, Höhenkrankheit oder Kälteschäden. Mit der Buchung nimmst du diese naturgegebenen Risiken bewusst in Kauf. Ich hafte nach den gesetzlichen Bestimmungen. Für Sachschäden ist meine Haftung – soweit gesetzlich zulässig – auf Vorsatz und grobe Fahrlässigkeit beschränkt; für Schäden an Leben, Körper und Gesundheit gilt keine Beschränkung.
12. Leihmaterial
Auf Anfrage verleihe ich technische Ausrüstung (z. B. Klettersteigset, Helm, Gurt, Steigeisen, Pickel, LVS-Gerät, Schaufel, Sonde) gegen eine kleine Leihgebühr, solange der Vorrat reicht – bitte früh anfragen. Das Material wird regelmäßig gewartet und geprüft. Verlust oder Beschädigung über die normale Abnützung hinaus wird in Rechnung gestellt.
13. Minderjährige
Minderjährige nehmen nur mit Einverständnis eines Erziehungsberechtigten teil. Bei Touren mit Kindern stimmen wir Mindestalter und Voraussetzungen vorab ab.
14. Gutscheine
Gutscheine sind 2 Jahre ab Ausstellungsdatum gültig und nicht in bar ablösbar. Konntest du einen Gutschein in dieser Zeit nicht einlösen, melde dich – wir finden eine Lösung. Für Termine, die mit einem Gutschein gebucht werden, gelten dieselben Stornobedingungen.
15. Fotos
Die Fotos unserer gemeinsamen Tour schicke ich dir nach der Tour gerne kostenlos. Bilder, auf denen du erkennbar bist, verwende ich auf dieser Website oder in sozialen Medien nur mit deinem Einverständnis.
16. Datenschutz
Wie ich mit deinen Daten umgehe, steht in der Datenschutzerklärung.
17. Anwendbares Recht und Gerichtsstand
Es gilt italienisches Recht. Gerichtsstand ist Bozen; bist du Verbraucher, gilt der gesetzliche Gerichtsstand an deinem Wohnsitz.
Condizioni generali
La cosa più importante: per ogni tour prenotato ti consiglio un'assicurazione annullamento viaggio (ad es. tramite l'Europäische Reiseversicherung). Le disdette all'ultimo momento per malattia, infortunio o motivi di lavoro purtroppo sono frequenti – con un'assicurazione annullamento non resti tu a sostenere i costi.
1. Parti contraenti e ambito di applicazione
La controparte contrattuale è Thomas Engl, guida alpina e maestro di scialpinismo abilitato (licenza ITBZ000416), Via Tasa 3, I-39037 Valles / Rio di Pusteria (BZ). Queste condizioni si applicano a tutte le escursioni guidate, i corsi e i buoni che prenoti presso di me.
2. Tariffa
I prezzi indicati su questo sito si intendono per persona e dipendono dalla dimensione del gruppo, dalla difficoltà e dai pericoli oggettivi del tour. La base è la tariffa minima delle guide alpine e maestri di scialpinismo dell'Alto Adige, fissata ogni anno per l'anno successivo. Se un tour viene prenotato con molto anticipo (ad es. più di un anno prima) e la tariffa minima cambia, posso adeguare il prezzo d'accordo con te; in tal caso puoi annullare gratuitamente. Per i tour di più giorni e quelli pianificati su misura ricevi in anticipo un'offerta dedicata con il prezzo complessivo.
3. Costi non inclusi
Non sono inclusi nel prezzo il tuo viaggio, vitto e alloggio (anche la mezza pensione in rifugio), le bevande nonché i costi di impianti di risalita, taxi, pedaggi e altri trasporti – per te e, nei tour con pernottamento, impianti o taxi, pro quota anche per me. Le spese sono indicate per ogni tour oppure riportate nell'offerta. Eventuali costi aggiuntivi non previsti (ad es. per una variazione dell'itinerario dovuta al meteo) sorgono solo d'accordo con te. Su richiesta ti faccio una stima approssimativa dei costi complessivi; fanno fede i prezzi di volta in volta aggiornati di rifugi e impianti.
4. Richiesta, prenotazione e pagamento
Le richieste tramite questo sito, per e-mail, telefono o WhatsApp non sono vincolanti. Un tour è prenotato in modo vincolante non appena te l'ho confermato per iscritto (e-mail o WhatsApp). Con la conferma ricevi tutte le informazioni sul tour e, se necessario, una lista dell'attrezzatura. Per tour di più giorni, corsi o prenotazioni in rifugio richiedo un acconto del 30 %; la prenotazione diventa vincolante solo al ricevimento dell'acconto. L'importo (residuo) è dovuto dopo il tour, in contanti oppure tramite PayPal o bonifico.
5. Nessun diritto di recesso
Trattandosi di servizi relativi al tempo libero con una data specifica, ai sensi del Codice del Consumo (D.Lgs. 206/2005), art. 59, comma 1, lett. n) non sussiste alcun diritto di recesso legale. Si applicano le seguenti condizioni di annullamento.
6. Annullamento da parte tua
Puoi annullare in qualsiasi momento per iscritto (e-mail o WhatsApp). Poiché le date disdette con poco preavviso di solito non possono più essere riassegnate, si applicano le seguenti penali di annullamento:
Tour giornalieri
- fino a 21 giorni prima del tour: gratuito
- da 20 a 8 giorni prima: 50 % del prezzo del tour
- da 7 a 3 giorni prima: 75 % del prezzo del tour
- da 2 giorni prima o in caso di mancata presentazione: 100 % del prezzo del tour
Tour di più giorni e corsi
- fino a 60 giorni prima del tour: viene trattenuto l'acconto
- da 59 a 30 giorni prima: 50 % del prezzo complessivo
- da 29 a 10 giorni prima: 75 % del prezzo complessivo
- da 9 giorni prima o in caso di mancata presentazione: 100 % del prezzo complessivo
Le penali di annullamento di terzi (rifugi, alloggi, biglietti ecc.) te le addebito tali e quali; ricevi un prospetto dettagliato. Se trovi una persona sostitutiva idonea, non si applicano penali di annullamento.
7. Meteo e condizioni
Se un tour può svolgersi in base al meteo o alle condizioni lo decido solo io in quanto guida alpina – fa parte della mia responsabilità. Se il tour previsto non è possibile, ti propongo un'alternativa equivalente. Se la rifiuti senza un motivo valido, si applicano le condizioni di annullamento. Se non è possibile un'alternativa sensata, cerchiamo insieme una data sostitutiva; in tal caso non ti derivano costi aggiuntivi. Nuvole in vetta o una visibilità limitata non danno diritto a una riduzione del prezzo.
8. Requisiti, modifica del programma e interruzione
I requisiti indicati nella descrizione del tour (condizione fisica, tecnica, attrezzatura) fanno parte del contratto. Valuta te stesso con onestà e informami di eventuali limitazioni di salute. Per motivi di sicurezza posso modificare l'itinerario o il programma, escludere singoli partecipanti o interrompere il tour – ad esempio in caso di cambiamento del tempo, cattive condizioni o se i requisiti non sono soddisfatti. In questi casi non sussiste alcun diritto a una riduzione del prezzo.
9. Annullamento da parte mia
Se devo annullare un tour (ad es. per malattia, infortunio o condizioni persistentemente inadatte), cerchiamo una data sostitutiva oppure organizzo un collega guida alpina. Se nessuna delle due soluzioni è possibile, ti vengono rimborsati integralmente gli importi già pagati; per te non si applicano penali di annullamento.
10. Assicurazione
Sono assicurato per la responsabilità civile professionale tramite la polizza collettiva dell'Associazione delle guide alpine dell'Alto Adige (copertura 10 mln € per persona e per sinistro, in tutto il mondo ad eccezione di USA e Canada). Per te personalmente il prezzo del tour non include alcuna assicurazione. Ti consiglio una tua assicurazione malattia, infortuni e per le spese di soccorso e recupero – ad es. tramite l'iscrizione a un club alpino – nonché un'assicurazione annullamento viaggio.
11. Responsabilità personale e responsabilità civile
Anche con una conduzione attenta e prudente, in montagna restano rischi residui che nessuno può escludere – ad esempio cadute, caduta sassi, valanghe, cadute in crepaccio, mal di montagna o congelamenti. Con la prenotazione accetti consapevolmente questi rischi naturali. Rispondo secondo le disposizioni di legge. Per i danni a cose la mia responsabilità è limitata – nei limiti consentiti dalla legge – ai casi di dolo e colpa grave; per i danni alla vita, al corpo e alla salute non vale alcuna limitazione.
12. Materiale a noleggio
Su richiesta presto attrezzatura tecnica (ad es. set da ferrata, casco, imbrago, ramponi, piccozza, ARTVA, pala, sonda) dietro un piccolo compenso di noleggio, fino a esaurimento – ti prego di chiedere per tempo. Il materiale viene regolarmente manutenuto e controllato. La perdita o il danneggiamento oltre la normale usura vengono addebitati.
13. Minorenni
I minorenni partecipano solo con il consenso di chi esercita la responsabilità genitoriale. Per i tour con bambini concordiamo in anticipo l'età minima e i requisiti.
14. Buoni
I buoni sono validi 2 anni dalla data di emissione e non sono convertibili in denaro. Se non sei riuscito a utilizzare un buono entro questo periodo, contattami – troveremo una soluzione. Per le date prenotate con un buono valgono le stesse condizioni di annullamento.
15. Foto
Dopo il tour ti invio volentieri e gratuitamente le foto della nostra uscita insieme. Le immagini in cui sei riconoscibile le uso su questo sito o sui social media solo con il tuo consenso.
16. Protezione dei dati

17. Legge applicabile e foro competente
Si applica la legge italiana. Il foro competente è Bolzano; se sei un consumatore, vale il foro previsto dalla legge presso il tuo luogo di residenza.
Terms and conditions
Most important first: for every tour you book, I recommend cancellation insurance (e.g. through the Europäische Reiseversicherung). Short-notice cancellations due to illness, injury or work commitments unfortunately happen often – with cancellation insurance you won't be left with the costs.
1. Contracting party and scope
Your contracting party is Thomas Engl, state-certified mountain and ski guide (licence ITBZ000416), Tasaweg 3, I-39037 Vals / Mühlbach (BZ), Italy. These terms apply to all guided tours, courses and vouchers you book with me.
2. Rates
The prices on this website are per person and depend on the group size, the difficulty and the objective hazards of the tour. They are based on the minimum rate of the South Tyrol mountain and ski guides, which is set every year for the following year. If a tour is booked very early (e.g. more than one year in advance) and the minimum rate changes, I may adjust the price in agreement with you; in that case you can cancel free of charge. For multi-day tours and individually planned tours you receive a separate offer with the total price in advance.
3. Costs not included
Not included in the price are your travel, meals and accommodation (including half board in huts), drinks as well as lift, taxi, toll and other transport costs – for you and, on tours with overnight stays, lifts or taxis, a proportionate share for me as well. The expenses are stated for each tour or listed in the offer. Unscheduled additional costs (e.g. due to a weather-related change of route) are only incurred in agreement with you. On request I will give you a rough estimate of the total costs in advance; the current prices of huts and lifts apply.
4. Enquiry, booking and payment
Enquiries via this website, by email, phone or WhatsApp are non-binding. A tour is bindingly booked as soon as I have confirmed it to you in writing (email or WhatsApp). With the confirmation you receive all information about the tour and, if needed, an equipment list. For multi-day tours, courses or hut reservations I require a deposit of 30 %; the booking becomes binding only once the deposit has been received. The (remaining) amount is due after the tour, in cash or via PayPal or bank transfer.
5. No right of withdrawal
As these are leisure services provided on a specific date, there is no statutory right of withdrawal pursuant to the Italian Consumer Code (Legislative Decree 206/2005), Art. 59(1)(n). The following cancellation terms apply.
6. Cancellation by you
You can cancel at any time in writing (email or WhatsApp). Since dates cancelled at short notice usually cannot be filled again, the following cancellation fees apply:
Day tours
- up to 21 days before the tour: free of charge
- 20 to 8 days before: 50 % of the tour price
- 7 to 3 days before: 75 % of the tour price
- from 2 days before or in case of no-show: 100 % of the tour price
Multi-day tours and courses
- up to 60 days before the tour: the deposit is retained
- 59 to 30 days before: 50 % of the total price
- 29 to 10 days before: 75 % of the total price
- from 9 days before or in case of no-show: 100 % of the total price
Cancellation costs charged by third parties (huts, accommodation, tickets etc.) are passed on to you one to one; you will receive a breakdown. If you provide a suitable replacement person, no cancellation fees apply.
7. Weather and conditions
Whether a tour can take place given the weather or conditions is decided by me alone as the mountain guide – this is part of my responsibility. If the planned tour is not possible, I will offer you an equivalent alternative. If you decline it without good reason, the cancellation terms apply. If no reasonable alternative is possible, we will find a new date together; in that case you will not incur any additional costs. Clouds on the summit or limited views are no reason for a price reduction.
8. Requirements, changes to the programme and termination
The requirements stated in the tour description (fitness, technique, equipment) are part of the contract. Please assess yourself honestly and inform me of any health limitations. For safety reasons I may change the route or programme, exclude individual participants or terminate the tour – for example in the event of a change in the weather, poor conditions or if the requirements are not met. In these cases there is no entitlement to a price reduction.
9. Cancellation by me
If I have to cancel a tour (e.g. due to illness, injury or persistently unsuitable conditions), we will find a new date or I will arrange for a fellow mountain guide. If neither is possible, you will receive a full refund of any amounts already paid; no cancellation fees apply to you.
10. Insurance
I have professional liability insurance through the group policy of the South Tyrol Mountain and Ski Guides Association (cover €10 million per person and per claim, worldwide except the USA and Canada). The tour price does not include any insurance for you. I recommend that you take out your own health, accident and rescue cost insurance – e.g. through membership of an alpine club – as well as cancellation or travel cancellation insurance.
11. Personal responsibility and liability
Even with careful and prudent guiding, residual risks remain in the mountains that nobody can rule out – such as falls, rockfall, avalanches, crevasse falls, altitude sickness or cold injuries. By booking, you knowingly accept these natural risks. I am liable in accordance with the statutory provisions. For damage to property my liability is limited – to the extent permitted by law – to intent and gross negligence; no limitation applies to injury to life, body or health.
12. Rental equipment
On request I lend technical equipment (e.g. via ferrata set, helmet, harness, crampons, ice axe, avalanche transceiver, shovel, probe) for a small rental fee, while stocks last – please ask early. The equipment is regularly maintained and inspected. Loss or damage beyond normal wear and tear will be charged.
13. Minors
Minors may only take part with the consent of a parent or legal guardian. For tours with children we agree on the minimum age and requirements in advance.
14. Vouchers
Vouchers are valid for 2 years from the date of issue and cannot be redeemed for cash. If you were unable to redeem a voucher within this period, get in touch – we will find a solution. The same cancellation terms apply to dates booked with a voucher.
15. Photos
I am happy to send you the photos of our tour together free of charge afterwards. I will only use pictures in which you can be recognised on this website or on social media with your consent.

17. Applicable law and place of jurisdiction
Italian law applies. The place of jurisdiction is Bolzano/Bozen; if you are a consumer, the statutory place of jurisdiction at your place of residence applies.
